Welcome to TorqShot. By accessing or using our service, you agree to be bound by these Terms of Service. Please read them carefully before using TorqShot.

1. Introduction and Acceptance

TorqShot ("we," "us," or "our") provides an AI-powered vehicle photo transformation service available at torqshot.com (the "Service"). By creating an account or using the Service, you ("you" or "User") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and TorqShot. We may update these Terms from time to time, and continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

TorqShot is an AI-powered platform that transforms vehicle photographs into professional studio-quality images. Users upload vehicle photos, select a studio scene, and our AI processing engine generates transformed images that place the vehicle into the chosen environment.

The Service includes:

  • Account creation and management
  • Vehicle photo uploading and project organization
  • AI-powered image transformation using selected studio scenes
  • Image downloading (individual and batch)
  • Credit-based usage system

3. Account Registration and Security

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits and Payments

TorqShot operates on a credit-based system. Each image transformation consumes one credit.

  • Purchasing Credits: Credits are available for purchase through our platform via our payment processor. Prices are displayed at the time of purchase.
  • Credit Usage: One credit is consumed per image transformation. Credits are deducted when processing begins.
  • No Refunds on Credits: Purchased credits are non-refundable. Unused credits do not expire unless your account is terminated for violation of these Terms.
  • Failed Processing: If an image transformation fails due to a system error on our end, the credit will be refunded to your account balance.
  • Price Changes: We reserve the right to change credit pricing at any time. Price changes will not affect previously purchased credits.

5. Acceptable Use

You agree to use TorqShot only for its intended purpose of transforming vehicle photographs. You must not:

  • Upload images that do not contain vehicles or are unrelated to automotive photography
  • Upload content that is illegal, offensive, defamatory, or infringes on third-party rights
  • Upload images containing identifiable persons without their consent
  • Attempt to reverse-engineer, decompile, or interfere with the Service
  • Use automated tools, bots, or scripts to access the Service without authorization
  • Resell or redistribute the Service itself (transformed images may be used commercially)
  • Circumvent any technical limitations or security measures

We reserve the right to remove content and suspend accounts that violate these guidelines.

6. Intellectual Property

  • Your Content: You retain all ownership rights to the original photographs you upload. By uploading images, you grant TorqShot a limited, non-exclusive license to process, transform, and temporarily store your images solely for the purpose of providing the Service.
  • Transformed Images: You own the transformed images generated by the Service. You are free to use them for personal or commercial purposes, including vehicle listings, marketing materials, and websites.
  • Our Service: The Service, including its design, features, AI models, studio scenes, and underlying technology, is owned by TorqShot and protected by intellectual property laws. Nothing in these Terms grants you rights to our technology beyond using the Service as intended.

7. AI-Generated Content Disclaimer

TorqShot uses artificial intelligence to transform images. While we strive for high-quality results:

  • AI-generated transformations may not always produce perfect results
  • Output quality depends on the quality and composition of the original photograph
  • Colors, reflections, and details in transformed images are AI-generated approximations
  • We do not guarantee that transformed images will be suitable for any specific purpose
  • You are responsible for reviewing transformed images before using them

8. Limitation of Liability

To the maximum extent permitted by law:

  • TorqShot is provided "as is" and "as available" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid for credits in the twelve months preceding the claim
  • We are not responsible for any decisions made based on transformed images

9. Termination

  • By You: You may close your account at any time. Unused credits will be forfeited upon account closure.
  • By Us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will provide notice when reasonably possible.
  • Effect of Termination: Upon termination, your right to use the Service ceases. We may delete your uploaded images and transformed outputs after a reasonable retention period.

10. Changes to Terms

We may modify these Terms at any time by posting the updated version on our website. Material changes will be communicated via email or a prominent notice on the Service. Your continued use after changes take effect constitutes acceptance.

11. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
